Brashear's Contract Won't Count Against Cap This Season

"According to the information I received, the problems with an over-35 contract really manifest themselves in the second or any subsequent year of the deal. In the first year of the deal, the over-35 player is just like anybody else, meaning if they are sent to the minors, or quit, or go to Europe, the money does come off the NHL team’s cap."
